Anayasam\u0131z kimsenin, ya\u015f\u0131na, g\u00fcc\u00fcne ve cinsiyetine uymayan i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131n\u0131, kad\u0131nlar, k\u00fc\u00e7\u00fckler ile ruhsal ve bedensel a\u00e7\u0131dan yetersizli\u011fi olan \u00e7al\u0131\u015fanlar\u0131n, \u00e7al\u0131\u015fma \u015fartlar\u0131 bak\u0131m\u0131ndan \u00f6zel olarak korunaca\u011f\u0131n\u0131 h\u00fckme ba\u011flam\u0131\u015ft\u0131r.<\/p>\n

Anayasada, yasalarda, ilgili t\u00fcz\u00fck ve y\u00f6netmeliklerde kad\u0131n i\u015f\u00e7iye pozitif bir ayr\u0131cal\u0131k tan\u0131nmas\u0131, kad\u0131n i\u015f\u00e7inin do\u011fas\u0131ndan kaynaklanan sebeplerle kad\u0131n\u0131n baz\u0131 i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lmamas\u0131 veya kad\u0131n\u0131n \u00f6znel durumundan kaynaklanan nedenlerle kad\u0131na \u00f6zel haklar tan\u0131nmas\u0131 e\u015fit davranma ilkesini zedelemek bir yana, bu ilkenin daha etkin bir \u015fekilde tesisine katk\u0131 sa\u011flamaktad\u0131r. Bu durum Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc (ILO) ile yap\u0131lan s\u00f6zle\u015fmelerde de korunmu\u015f ve uygulamaya ge\u00e7irilmi\u015ftir. Bu nedenle kad\u0131n i\u015f\u00e7ilerin \u00e7al\u0131\u015fma ko\u015fullar\u0131 hem i\u015f kanununda hem de ilgili t\u00fcz\u00fck ve y\u00f6netmeliklerde ayr\u0131nt\u0131l\u0131 olarak d\u00fczenlemi\u015ftir.<\/p>\n

A\u015fa\u011f\u0131da sizlere kad\u0131n i\u015f\u00e7inin gebelik s\u00fcresinde \u00e7al\u0131\u015fma ko\u015fullar\u0131, do\u011fum izni hakk\u0131 ve s\u00fct izni s\u00fcrelerinden yasal \u00e7er\u00e7eveler do\u011frultusunda bahsedece\u011fiz. \u00d6ncelikle yaz\u0131m\u0131zda olduk\u00e7a s\u0131k dile getirece\u011fimiz \u201ckad\u0131n i\u015f\u00e7i \u201ckavram\u0131n\u0131 a\u00e7\u0131klamakta fayda buluyoruz.<\/p>\n

Kad\u0131n i\u015f\u00e7i: Medeni durumuna bak\u0131lmaks\u0131z\u0131n on sekiz ya\u015f\u0131n\u0131 doldurmu\u015f kad\u0131n i\u015f\u00e7ileri ifade etmektedir.<\/p>\n

KADIN \u0130\u015e\u00c7\u0130N\u0130N DO\u011eUM \u0130ZN\u0130 NE KADARDIR?<\/strong>
\nKad\u0131n\u0131n Do\u011fum ve Do\u011fum Sonras\u0131 \u00c7al\u0131\u015fmas\u0131 Hakk\u0131nda 183 say\u0131l\u0131 Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc (ILO) S\u00f6zle\u015fmesi 4. madde ile kad\u0131nlara do\u011fum nedeniyle verilecek iznin 14 haftadan az olamayaca\u011f\u0131 h\u00fckm\u00fc getirilmi\u015f, do\u011fum sonras\u0131 verilecek iznin ulusal mevzuat \u00e7er\u00e7evesinde belirlenece\u011fini ancak bu iznin de 6 haftadan az olamayaca\u011f\u0131 belirtilmi\u015f; 8. madde ile kad\u0131n\u0131n hamilelik nedeniyle ayr\u0131ld\u0131\u011f\u0131 i\u015fine tekrar ayn\u0131 pozisyonda d\u00f6nebilmesi imkan\u0131 getirilmi\u015f; 10. madde ile kad\u0131n\u0131n \u00e7al\u0131\u015fma s\u0131ras\u0131nda bir veya daha fazla emzirme izni almas\u0131 d\u00fczenlenmi\u015ftir. Ayr\u0131ca s\u00f6zle\u015fmede do\u011fum sonras\u0131nda kad\u0131na hastal\u0131k yard\u0131m\u0131 yap\u0131lmas\u0131 ve kad\u0131nlar\u0131n hamilelik ve do\u011fum nedeniyle i\u015ften \u00e7\u0131kar\u0131lmalar\u0131n\u0131n yasaklanmas\u0131 gibi h\u00fck\u00fcmler yer almaktad\u0131r.<\/p>\n

5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun Ge\u00e7ici \u0130\u015f G\u00f6remezlik \u00d6dene\u011fi ba\u015fl\u0131kl\u0131 18. Maddesi c bendindende Sigortal\u0131 kad\u0131n\u0131n anal\u0131\u011f\u0131 halinde, do\u011fumdan \u00f6nceki bir y\u0131l i\u00e7inde en az doksan g\u00fcn k\u0131sa vadeli sigorta primi bildirilmi\u015f olmas\u0131 \u015fart\u0131yla, do\u011fumdan \u00f6nceki ve sonraki sekizer haftal\u0131k s\u00fcrede, \u00e7o\u011ful gebelik halinde ise do\u011fumdan \u00f6nceki sekiz haftal\u0131k s\u00fcreye iki haftal\u0131k s\u00fcre ilave edilerek \u00e7al\u0131\u015fmad\u0131\u011f\u0131 her g\u00fcn i\u00e7in ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi \u00f6denir. Yaz\u0131m\u0131zda kad\u0131n i\u015f\u00e7ilerin \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 ele ald\u0131\u011f\u0131m\u0131z i\u00e7in kad\u0131n i\u015f\u00e7inin hak etti\u011fi ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fini ba\u015fka bir yaz\u0131 ile sizlere anlataca\u011f\u0131z.<\/p>\n

4857 Say\u0131l\u0131 \u0130\u015f Kanununun Anal\u0131k halinde \u00e7al\u0131\u015fma ve s\u00fct izni ba\u015fl\u0131kl\u0131 74. Maddesinde de Kad\u0131n i\u015f\u00e7ilerin do\u011fumdan \u00f6nce sekiz ve do\u011fumdan sonra sekiz hafta olmak \u00fczere toplam on alt\u0131 haftal\u0131k s\u00fcre i\u00e7in \u00e7al\u0131\u015ft\u0131r\u0131lmamalar\u0131 esast\u0131r. \u00c7o\u011ful gebelik halinde do\u011fumdan \u00f6nce \u00e7al\u0131\u015ft\u0131r\u0131lmayacak sekiz haftal\u0131k s\u00fcreye iki hafta s\u00fcre eklenir. Ancak, sa\u011fl\u0131k durumu uygun oldu\u011fu takdirde, doktorun onay\u0131 ile kad\u0131n i\u015f\u00e7i isterse do\u011fumdan \u00f6nceki \u00fc\u00e7 haftaya kadar i\u015fyerinde \u00e7al\u0131\u015fabilir. Bu durumda, kad\u0131n i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreler do\u011fum sonras\u0131 s\u00fcrelere eklenir ifadesi yer almaktad\u0131r.
\nBa\u015fka bir deyi\u015fle, do\u011fuma \u00fc\u00e7 hafta kal\u0131ncaya kadar \u00e7al\u0131\u015fan bir kad\u0131n i\u015f\u00e7i, do\u011fum \u00f6ncesi sekiz haftal\u0131k izin s\u00fcresinin be\u015f haftas\u0131n\u0131 \u00e7al\u0131\u015farak ge\u00e7irdi\u011finden, bu s\u00fcreyi do\u011fum sonras\u0131na aktarabilecek ve b\u00f6ylece do\u011fum sonras\u0131 sekiz haftal\u0131k izin s\u00fcresine s\u00f6z konusu be\u015f haftan\u0131n da eklenmesi ile toplam on \u00fc\u00e7 hafta izin kullanabilecektir.<\/p>\n

Kad\u0131n i\u015f\u00e7ilerin do\u011fumdan \u00f6nce ve sonra sekizer haftal\u0131k s\u00fcrelerde \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 yasak oldu\u011fu i\u00e7in bu s\u00fcrelerde i\u015fe gelmeyen kad\u0131n i\u015f\u00e7inin hizmet akdi i\u015fverence feshedilemez. Yasa koyucu bu sayede do\u011fum iznine ayr\u0131lm\u0131\u015f i\u015f\u00e7inin i\u015fveren taraf\u0131ndan bu sebeple i\u015ften \u00e7\u0131kar\u0131lmas\u0131n\u0131n ve i\u015fveren taraf\u0131ndan hakl\u0131 feshin \u00f6n\u00fcne ge\u00e7mi\u015ftir.<\/p>\n

Doktor raporu ile gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde, gebe i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131na uygun daha hafif i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131labilir. Bu durumda \u00fccretten indirim yap\u0131lmaz. Ba\u015fka bir i\u015fe ge\u00e7i\u015f yap\u0131lmas\u0131 teknik ve elveri\u015fli olarak m\u00fcmk\u00fcn de\u011filse, kad\u0131n i\u015f\u00e7inin g\u00fcvenlik ve sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 i\u00e7in gerekli s\u00fcre i\u00e7inde, kad\u0131n i\u015f\u00e7inin de istemesi halinde \u00fccretsiz izinli say\u0131lmas\u0131 sa\u011flan\u0131r. Bu s\u00fcre, y\u0131ll\u0131k \u00fccretli izin hakk\u0131 hesab\u0131nda dikkate al\u0131nmaz.<\/p>\n

\u00d6rne\u011fin; 01.03.2011 tarihinde i\u015fe giren ve 01. 08.2011 tarihinden itibaren toplam on alt\u0131 hafta do\u011fum \u00f6ncesi ve sonras\u0131 izin kullanan kad\u0131n i\u015f\u00e7i, bu s\u00fcreler \u00e7al\u0131\u015f\u0131lm\u0131\u015f gibi say\u0131laca\u011f\u0131ndan 01.03.2012 tarihinde y\u0131ll\u0131k \u00fccretli izne hak kazanacak, do\u011fum izninden dolay\u0131 y\u0131ll\u0131k izne hak kazanma tarihi bak\u0131m\u0131ndan kayb\u0131 olmayacakt\u0131r.<\/p>\n

\u0130\u015f kanunu hamile kad\u0131n i\u015f\u00e7ilere, Do\u011fum \u00f6ncesinde ve sonras\u0131nda 8 er hafta s\u00fcre ile \u00fccretsiz izin verilmesini, \u00c7o\u011ful gebelik halinde do\u011fum \u00f6ncesi \u00fccretsiz izninin 10 hafta s\u00fcre ile kulland\u0131r\u0131lmas\u0131n\u0131 Hekim taraf\u0131ndan sak\u0131ncal\u0131 g\u00f6r\u00fclmemesi ve kad\u0131n sigortal\u0131n\u0131n talep etmesi halinde do\u011fum \u00f6ncesi iznini 3 haftaya kadar kulland\u0131r\u0131larak, kullanmad\u0131\u011f\u0131 do\u011fum \u00f6ncesi izin s\u00fcrelerini do\u011fum sonras\u0131 iznine ilave ederek kulland\u0131rmas\u0131n\u0131, Sa\u011fl\u0131k durumlar\u0131n\u0131n gerektirmesi halinde hekim raporu ile izin do\u011fum \u00f6ncesi ve sonras\u0131 izin s\u00fcrelerinin uzat\u0131lmas\u0131n\u0131, Hamilelik s\u00fcresince periyodik kontrol i\u00e7in \u00fccretli izin verilmesini, Kad\u0131n i\u015f\u00e7inin iste\u011fi halinde do\u011fum sonras\u0131 izninin bitti\u011fi tarihten itibaren 6 aya kadar \u00fccretsiz izin verilmesini, Hekim raporu ile gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde \u00fccretlerinden herhangi bir kesinti yap\u0131lmaks\u0131z\u0131n daha hafif i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n\u0131, \u00c7ocu\u011funun bir ya\u015f\u0131n\u0131 doldurmas\u0131na kadar kendisinin istedi\u011fi b\u00f6l\u00fcnt\u00fcde ve saatlerde kullanmak \u00fczere g\u00fcnde bir bu\u00e7uk saat s\u00fcreyle s\u00fct izni verilmesini Kanunun genel hatlar\u0131 ile anlatmaya \u00e7al\u0131\u015ft\u0131k.<\/p>\n","protected":false},"excerpt":{"rendered":"
